The case of Los Angeles Sheriff’s Deputy Trevor Kirk has seen promising developments after his civil rights conviction came under review by Bill Essayli, the new U.S. Attorney for the Central District of California.
Support for Deputy Kirk reached a peak when more than 20 sheriff’s stations across Los Angeles County opted out of the historic Baker to Vegas Challenge Cup Relay to highlight their backing of his legal battle against charges that many consider to be unjust.
The U.S. Attorney’s Office recently granted a delay in Deputy Kirk’s sentencing until August 18, 2025, citing U.S. Attorney Essayli’s need to review “significant matters pending in the Office, including this matter.”

The statement from the U.S. Attorney’s Office further indicated that the continuance would allow Essayli the opportunity to examine the facts and circumstances of the case, including those relevant to sentencing, and to confer with the trial team.
This announcement comes on the heels of an unprecedented show of solidarity from within the Los Angeles County Sheriff’s Department. The boycott of the prestigious Baker to Vegas race by numerous stations underscored the widespread concern and outrage within law enforcement regarding Deputy Kirk’s conviction and the implications it holds for their ability to perform their duties.
The case against Deputy Kirk stems from a June 24, 2023, incident at a Lancaster WinCo supermarket where he responded to a robbery call involving two suspects who had allegedly assaulted security officers.
Body-worn camera footage reportedly shows Deputy Kirk using pepper spray, a department-approved and relatively mild tool, to detain a combative suspect who resisted arrest, swung at him, and ignored his commands.
Despite what many perceive as lawful actions in line with his training, a viral video and subsequent media coverage allegedly misrepresented the suspect as an innocent bystander. This sparked significant activist pressure, ultimately leading to a federal indictment against Deputy Kirk for deprivation of rights under color of law.

In contrast, the charges against the robbery suspect were later dropped, and she proceeded to sue taxpayers. Adding another layer of complexity, a declaration filed on April 7, 2025, revealed that the suspects’ own attorney had been compelled to hire security for protection from her clients.
The Los Angeles Sheriff’s Professional Association (LASPA), representing thousands of deputies across the county, views the review by U.S. Attorney Essayli as a crucial step towards rectifying a perceived injustice and safeguarding law enforcement officers from what they believe are politically motivated prosecutions.
LASPA President Cesar Romero expressed cautious optimism, stating, “We’re cautiously optimistic that U.S. Attorney Essayli’s review will shine a light on the injustice done to Trevor Kirk. LASPA remains steadfast, vowing to continue its fight until Deputy Kirk is exonerated and the law enforcement community is safeguarded from such overreach and wrongful prosecutions.”
“As a former police officer, I know Trevor Kirk is the kind of officer you want on your side — honest, brave, and dedicated. His conviction sent shockwaves through the law enforcement community, making deputies second-guess their every move,” said Nick Wilson, LASPA Spokesperson. “We’re hopeful this review by the new U.S. Attorney will right a wrong and send a message: deputies who protect us and do their job properly shouldn’t be punished for it.”

Trevor Kirk’s attorney, Tom Yu, asserted the clarity of the evidence. “The evidence is crystal clear: Trevor Kirk acted lawfully, using minimal force to detain a robbery suspect who fought back. This prosecution was driven by a false narrative, not facts, and it’s heartening to know the Department of Justice is now giving it fair consideration. We will keep fighting until Trevor’s name is cleared and this travesty is overturned.”
The review by the new U.S. Attorney offers a glimmer of hope to Deputy Kirk and his supporters, signaling a potential reassessment of a case that has ignited significant debate and concern within the law enforcement community and beyond. The coming months will be critical as the U.S. Attorney’s Office examines the details of the case and determines its course of action.
