President Joe Biden’s recent pardon of his son, Hunter Biden, has become a focal point in the latest motion filed by attorneys for President-elect Donald Trump to dismiss his New York case. The defense team argued on Tuesday that Biden’s pardon amounts to an acknowledgment of political bias within the Department of Justice (DOJ), further justifying the dismissal of charges against Trump.

In their filing, Trump’s attorneys referenced Biden’s statement accompanying the pardon, in which the president claimed his son had been “selectively, and unfairly, prosecuted” due to political motivations.

The defense team argued that this admission condemns the DOJ’s practices under Biden’s leadership.

“These comments amounted to an extraordinary condemnation of President Biden’s own DOJ,” Trump’s legal team wrote. “This is the same DOJ that coordinated and oversaw the politically-motivated, election-interference witch hunts targeting President Trump.”

The motion also criticized the DOJ for its role in Special Counsel Jack Smith’s investigations and accused the department of sending Matthew Colangelo to assist Manhattan District Attorney Alvin Bragg in what they called an “empty and lawless” case against Trump.

The attorneys urged the court to dismiss the case without delay, citing its impact on Trump’s transition efforts following his November 2024 presidential election victory.

“Continuing this case disrupts President Trump’s transition efforts and his preparations to wield the full Article II executive power authorized by the Constitution pursuant to the overwhelming national mandate granted to him by the American people on November 5, 2024,” the filing stated.

The case has faced delays since November when Judge Juan Merchan indefinitely postponed Trump’s sentencing date. The defense had been instructed to submit their dismissal motion following the election, as Trump prepares to return to office.

Trump’s sentencing had been previously scheduled for November 26 but was delayed as legal proceedings unfold. The defense’s latest filing underscores their strategy of leveraging political narratives and recent actions by the Biden administration to strengthen their argument for dismissal.

The motion marks the latest escalation in a politically charged legal battle that has captivated the nation. The defense’s claims of DOJ bias, combined with Biden’s public statements, could further intensify scrutiny of the Justice Department’s role in high-profile cases involving political figures.
