Bytedance, the parent company of TikTok, has filed a lawsuit challenging the recent ban on its popular social media app in the United States.
In the lawsuit, TikTok argues that the ban is a “radical departure from constitutional principles” and violates the First Amendment right to free speech.
The company claims that the government’s decision to ban the app was based on unsubstantiated national security concerns and lacks sufficient evidence to justify such a drastic measure.

“Never before has Congress expressly singled out and shut down a specific speech forum,” TikTok said in one brief. “Never before has Congress silenced so much speech in a single act.”

The ban, which was signed into law by President Biden, prohibits federal employees from using or downloading TikTok on government devices.
The lawsuit contends that this ban not only harms TikTok’s business but also infringes upon the free speech rights of millions of American users who rely on the platform for expression, entertainment, and information.
