State and national teachers’ unions have filed a brief supporting a transgender Hillsborough County teacher challenging a Florida law that mandates educators use pronouns aligning with their sex assigned at birth. The unions argue that the law violates the teacher’s First Amendment rights and is part of a broader discriminatory effort against the LGBTQ+ community.

The Florida Education Association, National Education Association, and American Federation of Teachers argue that the law specifically targets transgender educators, prohibiting them from using pronouns that reflect their identity.
They contend that this restriction is unconstitutional and part of a larger pattern in Florida to suppress inclusion and target vulnerable minority groups.
The state, however, argues that school systems have the authority to regulate employee speech and that the law’s aim is to maintain order and prevent disruption in schools.

They claim the law doesn’t hinder teachers from expressing their views on preferred pronouns outside of the classroom.
The case, currently before the 11th U.S. Circuit Court of Appeals, revolves around a preliminary injunction issued by a district judge blocking enforcement of the law against the teacher.
The appeals court will hear arguments in September, and its decision could have significant implications for transgender rights and freedom of speech in educational settings.
