A Florida law banning those under 21 from purchasing rifles is facing a crucial test next week in a federal appeals court, with a recent Supreme Court ruling on a similar Pennsylvania law adding another layer of complexity.
The Supreme Court on Tuesday overturned a lower court’s decision that had blocked a Pennsylvania law prohibiting individuals under 21 from carrying guns during emergencies. This ruling comes just days before the 11th U.S. Circuit Court of Appeals is scheduled to hear arguments on the Florida law, which was enacted in 2018 following the tragic Parkland school shooting.

Both cases revolve around Second Amendment challenges to gun restrictions for young adults aged 18 to 20, and both rely heavily on interpreting Supreme Court precedents and the historical context of gun regulation. The Supreme Court’s decision in the Pennsylvania case, which cited a recent opinion upholding a gun ban for individuals under domestic violence restraining orders, could significantly influence the Florida case.
The NRA, which is challenging the Florida law, argues that it violates the Second Amendment right to bear arms. They contend that the law is not consistent with the nation’s historical tradition of firearm regulation. However, Florida maintains that the law is permissible and necessary to protect public safety, citing the Supreme Court’s acknowledgment that legislatures can restrict firearm purchases by individuals deemed to pose a “special danger of misuse.”
