Democrats in Congress may be preparing an anti-democratic insurrection of their own, albeit without the riot.
The Daily Caller reported on Friday that some senior Democrats say that if they regain the House, they will simply refuse to certify former President Donald Trump as the next president if he wins in November — as many polls now indicate he would.
The Daily Caller cited a recent article by The Atlantic that followed the recent U.S. Supreme Court hearing on the Democratic majority on Colorado’s highest court deciding to dump Trump from the ballot.

The Supreme Court seemed inclined to overturn the state’s decision on the grounds that one state should not decide the election in such a way.
“A Trump win could lead to a constitutional crisis in Congress,” the article stated. “Democrats would have to choose between confirming a winner many of them believe is ineligible and defying the will of voters who elected him.”
“Despite criticizing Republicans who voted against certifying President Joe Biden’s victory in 2020, several senior Democrats who spoke to The Atlantic reportedly left open the possibility of not certifying a Trump 2024 victory if the Supreme Court does not clearly rule on his eligibility,” the Daily Caller noted in summarizing the article.

Fox News, which also reported on The Atlantic piece, noted that Democratic Reps. Zoe Lofgren, James Clyburn, and Jamie Raskin, who challenged Trump’s first win in 2017, were among the Democrats interviewed by The Atlantic who specifically did not rule out disqualifying Trump.
On the other hand, Reps. Adam Schiff and Eric Swalwell said they would declare Trump the winner if he wins following a Supreme Court declaration that he is eligible to be on the ballot.
In a statement to the Tampa Free Press, Rep. Lofgren said. “I would like to clarify a recent statement attributed to me in the article, How Democrats Could Disqualify Trump If the Supreme Court Doesn’t, which I am concerned was not put in the full context of the interview. The Electoral Count Act does not permit disqualification of Electoral College votes based on insurrection activities of a candidate. After my work on the January 6th Select Committee, I am confident that Mr. Trump engaged in insurrection. The constitutional impact of his behavior is currently a murky legal question and under consideration by the Supreme Court. I would consider objecting to the electoral vote certification under the Electoral Count Act if the Supreme Court rules that the 14th Amendment required such action despite the Electoral Count Act. I am not considering objecting prior to the Supreme Court issuing its decision and if the decision provides that path legally. I regret that my statement was not clearer and want to be very clear now.”
