Rep. Matt Gaetz defended Daniel Penny, the U.S. Marine accused of manslaughter in the death of a menacing subway rider, calling him a “Subway Superman.”
Speaking on his “Firebrand” podcast on Friday, the Fort Walton Beach Republican said Penny acted in the face of a threat by the “dangerously insane” Jordan Neely, who died after Penny subdued him in a chokehold for several minutes.
Neely, Gaetz noted, had 42 prior arrests, many of which were for crimes in the subway system. When Neely threatened his fellow passengers, Penny acted, rather than “sit there like an extra in the movie,” said Gaetz.

“These soft-on-crime policies like we see in New York kill,” said Gaetz. “It’s just a matter of who.”
Gaetz then reiterated his previous call to reopen asylums, where mentally ill people could be housed, treated, and perhaps received a “renewed life.”
“But the left doesn’t actually want this,” he continued. “These [George] Soros prosecutors like [Manhattan District Attorney] Alvin Bragg want you to fear for your life. They’d rather you die than defend yourself.”
Now, rather than remove Neely from the streets when they had ample opportunities to do so, prosecutors want Penny in jail.
“Daniel had the nerve to stand up to the anarcho-tyranny that is running rampant throughout New York, and particularly the subway system,” said Gaetz.

“When good men sit silently as criminals and deviants take over our streets, evil gains ground. It’s not only permissible, it’s right and just to act in self-defense and in defense of others,” Gaetz added.
Gaetz then called for Bragg to drop the charges against the 24-year-old Marine. He also announced that he would personally donate to Penny’s legal defense fund on GiveSendGo.
In posting the video on Twitter, Gaetz added, “Subway Superman’ Daniel Penny is a HERO.”
