The Pennsylvania Supreme Court ruled on Monday that mail ballots with incorrect dates “shall not be counted” in the November 5 election. The decision came after the Republican National Committee (RNC) filed a lawsuit last Thursday against several counties that had opted to count these misdated ballots.
“Following our latest RNC lawsuit, today the Pennsylvania Supreme Court ruled yet again that undated ballots CANNOT BE COUNTED,” RNC Chairman Michael Whatley said on X. ““No more excuses. Election officials in Bucks, Montgomery, Philadelphia, and other counties have absolutely no choice but to reject illegal ballots. We will hold them to it.”

Despite the ruling, Bucks County commissioners had voted on Thursday to allow misdated ballots to be counted, as the Senate race between Democratic incumbent Bob Casey and Senator-elect Dave McCormick heads toward a recount.
Earlier, on November 1, the Pennsylvania Supreme Court reaffirmed that the requirement for mail ballots to include handwritten dates is constitutional.
