Nicois Megale Smith, 40, of Oklahoma City, has been sentenced to 84 months (7 years) in federal prison for illegally possessing a firearm after a previous felony conviction, announced U.S. Attorney Robert J. Troester. His father, Albert Smith, Jr., 62, had previously received the same sentence, bringing the total to 14 years for the pair.
A federal grand jury returned a three-count Indictment on August 16, 2023, charging Nicois with two counts of being a felon in possession of a firearm, and Albert with one count of the same charge.

Albert Smith, Jr., pleaded guilty on June 10, 2024, to being a felon in possession of a firearm in early May 2023. He admitted to possessing a pistol that he had reason to believe was stolen.
Two days later, on June 12, 2024, a federal jury found Nicois Smith guilty on one of his two counts.
Evidence presented at Nicois’s trial established that on May 21, 2023, Oklahoma City Police Department officers investigating a crime near Nicois’s home conducted a search of his residence and found a loaded pistol in the bedroom. Evidence connected Nicois to the firearm.
The court records indicate that both Nicois and Albert Smith have extensive criminal histories.

Nicois Smith’s previous convictions in Oklahoma County District Court include:
- Possession of a controlled dangerous substance with intent to distribute and carrying a weapon.
- Four counts of burglary and possession of cocaine with intent to distribute.
- Felon in possession of a firearm.
Albert Smith, Jr.’s previous felony convictions in Oklahoma County District Court include:
- Larceny of merchandise from a retailer.
- Assault and battery with a dangerous weapon.
- Possession of cocaine base.
- First-degree arson.
- Assault and battery with a dangerous weapon.
At the sentencing hearing on March 24, 2025, U.S. District Judge Joe Heaton sentenced Nicois Smith to 84 months in federal prison, followed by three years of supervised release. Albert Smith, Jr., had been sentenced on October 31, 2024, to the same term. The Court cited the defendants’ extensive criminal histories when announcing the sentences.
