Fabcon Precast LLC, a concrete manufacturing company with a facility in Grove City, Ohio, has pleaded guilty to a federal criminal charge for violating an Occupational Safety and Health Administration (OSHA) safety standard. The charge stems from a 2020 incident where an employee was killed due to a faulty pneumatic door.
On June 6, 2020, 20-year-old Zachary Ledbetter, a batch operator at the facility, was attempting to fix a jammed concrete mixer discharge door when it closed on his head, trapping him. He sustained fatal injuries and died five days later.

An investigation revealed that the exhaust valve meant to release pneumatic energy and render the door inoperable was broken. The handle operating the valve had broken off months prior and was never replaced, leaving employees unable to safely address malfunctions.
Federal law classifies the company’s offense as a class B misdemeanor for willfully failing to follow an OSHA safety standard, resulting in an employee’s death. This is the only federal criminal charge specifically addressing such workplace safety violations.

Fabcon Precast LLC faces a potential fine, which will be determined at a sentencing hearing. This case serves as a reminder for companies to prioritize workplace safety and ensure compliance with OSHA standards to prevent future tragedies.
