Michigan Attorney General Dana Nessel has joined a coalition of 20 state attorneys general in filing an amicus brief to support a lawsuit seeking to block the implementation of President Donald Trump’s executive order banning transgender individuals from serving in the military.
The coalition argues that the ban is unconstitutional, discriminatory, and harmful to national security, particularly as it impacts transgender service members honorably serving in the U.S. military, including the National Guard.
The amicus brief, filed in the United States District Court for the District of Columbia, supports a request for a preliminary injunction brought by a group of current and prospective transgender service members. The court is scheduled to hear arguments today, February 18, 2025.
In a statement, Attorney General Nessel emphasized the importance of inclusivity and respect for all service members. “Everyone who puts on a uniform to protect our country deserves our respect and the opportunity to serve,” Nessel said. “Banning transgender people from military service is not only discriminatory but is also harmful to our national security and unconstitutional. Service members and those inspired to serve should feel respected, welcomed, and valued, regardless of how they identify.”
Nessel added that the executive order threatens the well-being of all Americans and undermines the principles of equality and fairness. “This type of discrimination threatens the well-being of all Americans, and I proudly join my colleagues in standing with transgender military members against yet another dangerous and illegal Trump executive order.”

The coalition’s brief argues that President Trump’s executive order violates the Fifth Amendment’s guarantee of equal protection under the law.
The attorneys general also contend that the ban would weaken the military by depriving it of experienced and qualified service members at a time when recruitment challenges are already straining military readiness.
