U.S. Senators Rand Paul (R-KY) and Ron Wyden (D-OR) introduced a bipartisan resolution on Tuesday aimed at terminating the national emergency declaration that has been used to justify the imposition of broad tariffs on imported goods.

The resolution seeks to reaffirm Congress’s constitutional authority over tax policy by ending the use of emergency powers to circumvent legislative oversight.

Senator Paul emphasized the constitutional argument against the president’s tariff actions, stating, “Tariffs are taxes, and the power to tax belongs to Congress—not the president. Our Founders were clear: tax policy should never rest in the hands of one person. Abusing emergency powers to impose blanket tariffs not only drives up costs for American families but also tramples on the Constitution. It’s time Congress reasserts its authority and restores the balance of power.”

The resolution specifically targets the emergency declared in Executive Order 14257, which has enabled tariffs of up to 49% on a wide range of imported goods. Supporters of the resolution argue that these tariffs will lead to higher prices for American consumers and retaliatory tariffs that will harm U.S. manufacturers and farmers.

Paul has consistently opposed the use of national emergency declarations to bypass Congress, particularly when those actions have significant and long-lasting economic consequences.

This resolution is presented as a continuation of his efforts to protect the constitutional system of checks and balances and ensure that Congress retains its rightful power over the nation’s tax policies.
