A Kentucky man is facing serious charges for his alleged actions during the January 6th, 2021, breach of the U.S. Capitol. He is accused of assaulting law enforcement officers with a dangerous weapon, among other offenses.

Andrew Kyle Grigsby, 29, of Louisville, Kentucky, was indicted on five felony charges, including:

  • Civil disorder
  • Assaulting, resisting, or impeding officers using a dangerous weapon and inflicting bodily injury
  • Entering and remaining in a restricted building with a dangerous weapon
  • Disorderly and disruptive conduct in a restricted building using a dangerous weapon
  • Engaging in physical violence in a restricted building with a dangerous weapon

Grigsby also faces two misdemeanor charges: disorderly conduct in a Capitol building and an act of physical violence on Capitol grounds.

According to court documents, Grigsby breached the restricted perimeter of the Capitol grounds on January 6th and made his way to the Northwest stairwell of the Capitol building. Around 1:54 PM, he allegedly attempted to breach a police line while holding a black canister. Grigsby is accused of spraying a liquid, believed to be bear spray, at the officers defending the stairwell and the building.

The attack forced officers to retreat temporarily, with one officer reporting experiencing unbearable pain and difficulty breathing and seeing. Surveillance footage shows Grigsby leaving the scene while still holding the canister.

Grigsby was arraigned on January 10th, 2025, and is currently incarcerated in Washington D.C. The case is being prosecuted by the U.S. Attorney’s Office for the District of Columbia and the Department of Justice National Security Division’s Counterterrorism Section.

The FBI’s Louisville and Washington Field Offices are investigating the case, with assistance from the U.S. Capitol Police and the Metropolitan Police Department.
