Special counsel Jack Smith filed a new indictment on Tuesday against former President Donald Trump related to alleged attempts to overturn the results of the 2020 presidential election.
While the indictment retains the original criminal charges, it narrows the scope of the allegations following a recent Supreme Court ruling that granted broad immunity to former presidents.
The updated indictment omits a section that previously accused Trump of attempting to use the Justice Department’s law enforcement powers to reverse his election defeat.

This change comes in response to the Supreme Court’s 6-3 decision last month, which ruled that Trump is immune from prosecution for specific actions taken during his presidency.
This revised indictment marks the prosecutors’ initial effort to align with the Supreme Court’s ruling, which is expected to significantly alter the case against Trump regarding his efforts to disrupt the peaceful transfer of power.
The filing occurred just days before the special counsel’s office was required to inform the judge on how they planned to proceed in light of the court’s opinion, which presumes former presidents are immune from prosecution for official acts performed while in office.

The special counsel’s office noted that the updated indictment, filed in federal court in Washington, was issued by a grand jury that had not previously reviewed evidence in this case.
