HILLSBOROUGH COUNTY, Fla. – They met on an online dating service in March 2020. By the end of the month, “Jane Doe” and Patrick Gilliland engaged in protected sex. Shortly thereafter, they disconnected until July.
By August, “Jane Doe” and Gilliland engaged in unprotected sex several times, and “Doe” wound up with genital herpes.
Now she’s suing in the Hillsborough County courts for “Negligent and Intentional Transmission of a Sexually Transmitted Disease,” “Battery” and “Fraudulent Concealment.”
Gilliland, according to LinkedIn is a real estate consultant for Lucky’s Market, but most business information websites and news articles refer to him as co-founder and vice president of real estate for the organic food store chain.
It recently shuttered 20 of its 21 stores, including the former Lucky’s Market in St. Petersburg near Tyrone Square Mall. He has also been affiliated with other stores, namely Wild Oats and Sunflower Markets.
Gilliland allegedly presented “Jane Doe” with a negative panel of STD tests in August before their unprotected sexual relations. But “Doe” claims he eventually admitted to carrying the virus after declaring he was STD-free.
She also claims Gilliland’s STD tests were “fake” because his name was misspelled and his date of birth was incorrect. “Doe” became ill with the herpes virus a few days after their unprotected sexual activity.
According to the lawsuit, she had no sexual contact with other men during the period of sexual activity with Gilliland.
According to the Arizona Republic in February 2011, Gilliland’s brother, Former CEO of Sunflower Markets, Michael Gilliland, was arrested on suspicion of child prostitution in an Arizona sex sting operation. A year and a half later, Gilliland pleaded guilty, to a lesser charge, attempted pandering.
“Jane Doe’s” attorney is Julian V. Stroleny of Stroleny Law in Miami and Aaron A. Karger of North Miami Beach. They could not be reached for comment. No current court documents identify Gilliland’s defense attorney.
