Florida’s Medicaid Ban On Transgender Care Goes To Appeals Court In Atlanta

The 11th U.S. Circuit Court of Appeals In Atlanta has scheduled a hearing on November 22nd to address a legal battle over Florida’s prohibition of Medicaid coverage for gender-affirming care, such as hormone therapy and puberty blockers, for transgender individuals.

This case began in 2022 when a lawsuit was filed on behalf of two transgender adults and the parents of two transgender minors following the state Agency for Health Care Administration’s rule change barring such coverage.

The lawsuit was later amended to include a new state law with similar restrictions.

In June 2023, U.S. District Judge Robert Hinkle ruled that the ban violated federal healthcare laws and the Constitution’s Equal Protection Clause.

However, Governor Ron DeSantis’ administration has appealed this decision, setting the stage for the upcoming hearing in Atlanta.
