Rep. Matt Gaetz of Florida said Wednesday that he would join an effort by House Republicans to block the Biden administration’s new rule that allows men into women’s sports, restrooms, and locker rooms.
Last week, the United States Department of Education announced its final Title IX regulations, which, among other things, now makes it a matter of federal law that schools allow biological men into women’s college sports, locker rooms, and bathrooms,” Gaetz said in an X post.
“This rule is a wish list for the far left, including unlawfully expanding the scope of the rule off campus, lowering due process protections for students accused of misconduct, entrenching kangaroo courts, and delinking ‘sex discrimination’ from biological sex,” he added.

“As the costs of education continue to go up, it’s telling that President [Joe] Biden is more concerned with giveaways to a bloated and weaponized bureaucracy, and I’m proud to be supporting efforts in the House to block this rule under the Congressional Review Act.”
The Education Department’s rule essentially gutted the 1972 federal law known as Title IX, a one-sentence provision that ensured women have equality in federally funded educational settings.
The administration that surely would shudder at having to formally define what a woman is, simply expanded the definition of “gender” by rule to essentially gut existing law.
As Epoch Times columnist Sarah Parshall Perry wrote on Wednesday, “This simple longstanding prohibition on sex discrimination has been manipulated by the Biden administration to both undermine constitutional freedoms—like the freedom of speech—and erase the very women that Title IX was enacted to protect.”

“The Department of Education has unilaterally expanded the prohibition against discrimination based on ‘sex’ to include a prohibition against discrimination based on: ‘sex stereotypes, sex-related characteristics (including intersex traits), pregnancy or related conditions, sexual orientation, and gender identity.’”
“Under the Biden administration’s sweeping new Title IX rule,” Perry added, “any K–12 school or institution of higher education that receives any federal funding would have to open girls’ bathrooms, locker rooms, housing accommodations, sports teams, and any other sex-separated educational program or offering to biological boys who claim to ‘identify’ as girls. Similarly, boys’ facilities would have to be accessible to biological girls who ‘identify’ as boys.”
In Florida, meanwhile, state Education Secretary Manny Diaz Jr. directed local school systems to not take action on President Joe Biden’s rule.
Diaz sent a letter on Friday to county school superintendents and districts, saying, “Florida will fight this.”
“The Biden Administration maims the statute beyond recognition in an attempt to gaslight the country into believing that biological sex no longer has any meaning,” Diaz wrote.
Louisiana and Oklahoma have also told their school districts to not enforce Biden’s rule.
