Florida Rep. Matt Gaetz Intros “Resentencing Integrity Act Of 2024” For J6 Defendants

In response to Federal Bureau of Prisons Director Colette Peters’ testimony before the House Judiciary Committee, U.S. Congressman Matt Gaetz (FL-01) introduced the “Resentencing Integrity Act of 2024” today.

The proposed legislation aims to prevent federal prosecutors from retaliating against January 6th defendants petitioning for resentencing.

Before the Supreme Court’s decision in Fischer v. United States, Biden DOJ officials had threatened to seek additional jail time for individuals who sought resentencing after their initial sentences were deemed illegal.

This bill would require courts to credit the time served towards any new sentence, ensuring a fairer process, according to Gaetz. The bill would cap this credit at 10 years.

“My bill, the Resentencing Integrity Act of 2024, will provide significant relief for January 6th defendants and ensure federal prosecutors stop aggressively pursuing charges if defendants petition for resentencing. Additionally, it will ensure that justice is served fairly, balancing the need for accountability with the protection of individual rights,” said Congressman Gaetz.

If enacted, this legislation will offer significant protections for those affected by the January 6th events, ensuring their rights are upheld while maintaining the integrity of the judicial process.
