In a fiery appearance on Fox Business Thursday, Florida Rep. Kat Cammack (R-FL) called on Congress to reassert its constitutional authority over the federal judiciary following a high-profile ruling by a Biden-appointed judge blocking a Trump administration policy.
Judge Ana Reyes issued a temporary injunction this week halting President Donald Trump’s executive order that bans transgender individuals from serving in the U.S. military, pending a final ruling. The decision sparked backlash from conservatives, with Cammack accusing the judiciary of “lawfare” and political activism.

“We have abdicated our authority,” Cammack said on The Evening Edit. “Article 2 clearly delineates power to the judiciary, but it was actually Congress that created the lower courts. We haven’t updated or exercised that authority since 1911. It’s time for Congress to step up.”
Cammack also promoted the REINS Act — Regulations from the Executive In Need of Scrutiny — a bill she introduced to rein in federal agency rulemaking and restore congressional oversight. The legislation would require any major rule from executive agencies to be approved by Congress before taking effect and allow Congress to override non-major rules through a joint resolution.
“This is the biggest, baddest swamp-draining, empower-the-people bill out there,” said Cammack. “Nothing scares the swamp more than an informed, motivated, educated, and engaged electorate.”
Cammack framed the REINS Act as a tool to fight bureaucratic overreach and judicial activism, especially in an era where, she claims, the courts have become partisan battlegrounds.

The congresswoman didn’t mince words when addressing what she views as politically motivated rulings from the bench.
“Everything that we’re seeing is lawfare,” Cammack said. “Over 60% of the injunctions have been against President Trump — over 90 of them from Democrat-appointed judges. Just because you don’t like the outcome of an election doesn’t mean you can weaponize the judiciary.”
Cammack’s comments came after Judge Reyes cited a line from the musical Hamilton — “all people are created equal” — as part of her ruling to block the transgender military ban. Reyes criticized the Trump administration’s policy as being rooted in bias and speculation rather than military necessity.
Defense Secretary Pete Hegseth, who has overseen the implementation of the executive order, defended the administration’s stance, arguing that removing “left-wing social engineering” from the military is essential to combat readiness.
Cammack echoed that sentiment, demanding that Congress reassert its role in defining the structure and scope of the judiciary and federal agencies.

“We need to put an end to unelected judges and bureaucrats rewriting national policy,” she said. “This is about restoring balance and power to the people through their elected representatives.”
Cammack is reportedly working to build support for the REINS Act in the House and is expected to push for broader reforms targeting the judiciary’s structure and authority — reforms that could include revisiting judicial term limits, jurisdictional constraints, and budgetary oversight of the courts.
With increasing tension between the executive branch and the courts, Congress may be the next battleground for determining the future role of the judiciary in shaping national policy.
