The U.S. House of Representatives has passed H.R. 9596, “The Bipartisan Value Over Cost Act”, introduced by Congressman Byron Donalds (R-FL). The legislation, which aims to make government operations more efficient, was approved by voice vote with broad bipartisan support.
The “Bipartisan Value Over Cost Act” seeks to modernize federal procurement processes by:
- Increasing flexibility in government contracts.
- Enhancing competition among contractors.
- Reducing regulatory burdens for small businesses.
- Maximizing the government’s ability to procure cutting-edge technology.
- Streamlining decision-making for federal acquisitions to emphasize long-term value over short-term costs.
The legislation focuses on improving the General Services Administration’s (GSA) Multiple Award Schedule (MAS) program, the federal government’s primary contracting procedure for acquiring commercial products and services.

The MAS program, guided by procurement standards established in 1984, often prioritizes “lowest overall cost” in awarding contracts. Critics argue that this approach stifles innovation, raises administrative costs, and limits competition.
H.R. 9596 introduces “best value” evaluation criteria, allowing agencies to prioritize contracts offering the greatest overall benefit, not just the lowest price.
This is the 25th piece of legislation authored by Congressman Donalds to pass the House during the 118th Congress. The bill’s bipartisan support is evident, with co-sponsors including Representatives Troy Nehls (R-TX), Clay Higgins (R-LA), Lauren Boebert (R-CO), and Jared Moskowitz (D-FL).

The legislation will now move to the Senate for consideration. If enacted, it is expected to modernize government contracting processes, save taxpayer money, and foster greater innovation in federal procurement.
