Florida Professors Challenge New Tenure Law, Claiming Violation Of Board of Governors’ Authority

Professors in Florida are taking legal action against the state’s new tenure law, arguing that it oversteps the constitutional power of the Board of Governors.

The lawsuit, filed by Sarah Hernandez, Steven J. Willis, and Adriana Novoa, challenges the legislation mandating five-year post-tenure reviews and altering the tenure review process.

The plaintiffs contend that these changes infringe on the Board of Governors’ authority to manage tenure policies within the state university system.

They seek a declaration that the law violates Article IX ยง 7 of the Florida Constitution. The outcome of this lawsuit could significantly impact tenure policies in Florida’s higher education institutions.
