Senator Rick Scott (R-FL) joined Senators Ted Cruz (R-TX) and Thom Tillis (R-NC) in introducing the Make American Flags in America Act, a bill aimed at ensuring that all American flags displayed by federal agencies and purchased with taxpayer dollars are made entirely in the United States.
The bill closes loopholes that have allowed Chinese manufacturers to sell American flags falsely labeled as U.S.-made. It builds upon the All-American Flag Act, signed into law in 2024, which required that federal agencies only purchase flags manufactured in the U.S. with domestic materials but did not fully eliminate foreign-made flags from entering the market.

Senator Rick Scott emphasized the symbolic and economic importance of keeping American flag production in the U.S.
“The American flag represents the pride and joy of being an American and the very values of a nation founded upon freedom, democracy, and the American dream,” Scott said. “Producing an American flag is a privilege that should only be granted to our fellow Americans who believe in the values it represents, not nations like Communist China who seek to destroy the American way of life.”
Senator Ted Cruz called for Congress to act quickly in closing the loopholes that have allowed Chinese manufacturers to exploit weak labeling laws.
“There is bipartisan agreement that American flags should be produced in America using American materials, but loopholes in existing laws still allow Chinese manufacturers to sell flags, including through fraudulently-branded websites,” Cruz said. “This bill would close those loopholes. Congress should take it up and expeditiously pass it.”
The legislation ensures that:
- All American flags displayed on federal property must be 100% made in the U.S.
- Federal agencies cannot use taxpayer funds to purchase flags unless they are fully manufactured from U.S.-grown and produced materials.
- A study by the Federal Trade Commission (FTC) will assess enforcement of country-of-origin labeling for American flags, with a focus on cracking down on fraudulent labeling.
Despite the passage of the All-American Flag Act in 2024, foreign-made flags—especially from China—continue to enter the U.S. market, often through e-commerce platforms falsely advertising their products as American-made.
The new bill aims to eliminate an acquisition threshold that allows some foreign-made flags to be used in federal procurement and strengthens enforcement mechanisms to prevent deceptive sales practices.
