Florida Judge Reprimanded For Improper Comments

Miami-Dade Circuit Judge Alberto Milian received a public reprimand from the Florida Supreme Court for improperly commenting on a motion to disqualify him from a case.

This follows an investigation by the Florida Judicial Qualifications Commission which found that Milian violated judicial rules by disputing allegations within the motion.

This isn’t the first time Milian has faced such accusations, with a similar incident occurring in 2016. The Supreme Court justices unanimously agreed that Milian’s actions were inappropriate and violated judicial canons, which require judges to maintain public confidence in the judiciary, uphold professional competence, and ensure fair legal proceedings.

Commenting on disqualification motions puts judges in an adversarial position against the filing party, compromising impartiality. Milian acknowledged his wrongdoing in a stipulation and accepted responsibility. The public reprimand was issued through the publication of the court’s order.
