Florida Governor Ron DeSantis Thursday announced a lawsuit against the Biden administration and the U.S. Department of Education.
According to DeSantis, the lawsuit focuses on accreditation agencies, which DeSantis and Florida Attorney General Ashley Moody claim unconstitutionally trump Florida policies.
During a press conference in Tampa Thursday, DeSantis said the current process is unconstitutional because it violates the private non-delegation doctrine, the appointment clause, and the spending clause.
“Under their theory, the accreditor can serve as a veto against the entire state of Florida. That if our legislature passes, you know, reasonable reforms, the governor signs it, that they somehow get a veto of that process. I’ve read the state and federal constitutions a lot, and I don’t recall seeing that clause in either of those constitutions,” said DeSantis Thursday.

“We reject the idea that a totally unaccountable, unappointed, unelected accrediting agency can trump, what the state of Florida is doing,” said DeSantis.
“So the attorney general and I today are filing a lawsuit against the Biden administration, against the Department of Education, Secretary Cardona, and other plaintiffs. And we’re asking the court to find this arrangement to be unconstitutional, and it’s unconstitutional,” DeSantis said.
The lawsuit was filed in federal court in Fort Lauderdale, according to DeSantis.
