Florida Gov. Ron DeSantis called it “pathetic” that President Joe Biden can essentially be declared “too senile” not to face charges for mishandling classified documents but still retain control of the most powerful military arsenal the world has ever seen.

The Republican governor made the comment on Friday during an interview with Fox News host Mark Levin.

Levin had asked for DeSantis’ reaction to Special Counsel Robert Hur’s decision not to prosecute Biden for illegally stashing classified records at his Delaware home and an office in Philadelphia because a jury would be persuaded to excuse Biden as a “well-meaning, elderly man with a poor memory.”

“I think there’s been a lot of focus, understandably, on the provision [of Hur’s report] saying, ‘Hey, this guy is just too senile actually to stand trial, a jury wouldn’t convict him.’ And I think … OK, you can’t stand trial, but somehow you can have the nuclear codes?” DeSantis said.

DeSantis then suggested that if Hur and the Justice Department were not going to pursue charges, in part because Biden is the sitting president, then it may be time to invoke the 25th Amendment.

“This was willful retention of documents over many decades,” DeSantis argued. “This was like a pattern in practice when he was a U.S. senator, when he was vice president when he got out of office.”

The governor also compared it to Hillary Clinton’s case. Clinton, as U.S. secretary of state, ran a private computer network server in her home instead of using government tech and exchanged classified information that was susceptible to being compromised.

DeSantis said Clinton also “merited prosecution,” but her case was slightly different because where Biden wanted to keep classified records, Clinton’s classified materials were caught up in the document traffic that she wanted to be able to hide from public records requests. DeSantis said Biden “was even more willful” in his illegal conduct because it was a “pattern of practice.”

“These documents are sprinkled over how many different locations and so clearly, you know, they had the goods if they wanted to go forward and recommend” prosecution, said DeSantis.

“But they’re hanging their hat on the fact that this guy is effectively not mentally competent to stand trial,” he added. “How pathetic is that for our country? This is the guy that has the nuclear codes.”
