Florida AG Moody Fights Back Against Biden’s Overreach On Washing Machines

Florida Attorney General Ashley Moody of Florida has led a coalition of 23 state attorneys general in opposing the Biden administration’s latest regulatory overreach.

This time, the administration has set its sights on the humble washing machine, attempting to impose stringent energy efficiency standards that could significantly impact consumers’ wallets and household chores.

“The Biden administration remains adamant on continuing to push radical, stringent and costly energy policies directly into your household in hopes that no one will notice—this time, weaseling into our laundry rooms. As a mom and your Attorney General, I am proud to fight on behalf of moms against white baseball pants and push back to keep these senseless policies out of American households,” said Moody.

The catalyst for this legal battle is a newly released direct final rule from the United States Department of Energy (DOE), which aims to regulate residential clothes washers. The rule, which was developed without proper public input, proposes a set of energy efficiency standards that could have far-reaching consequences for American households.

According to the coalition of attorneys general, the proposed regulations fail to consider the economic impact on consumers, who would likely face significant price hikes for their washing machines. The rule, if implemented, could eliminate consumer features, reduce choice, and negatively impact product performance, as highlighted by the Association of Home Appliance Manufacturers (AHAM) and industry leaders like Whirlpool.

The attorneys general argue that the DOE’s rulemaking process was flawed, as it did not adequately address the concerns raised by important stakeholders during the public comment period. AHAM, a leading industry group, expressed major reservations about the proposed standards, warning that they could result in a 25% increase in consumer costs and a potential 31% loss in industry net present value, potentially leading to the loss of more than 8,000 American jobs.

Furthermore, the coalition contends that the DOE’s reliance on the support of several advocacy groups, such as the Alliance for Water Efficiency, the Northwest Energy Efficiency Alliance, the Natural Resource Defense Council, Earthjustice, and the National Consumer Law Center, does not represent the interests of everyday consumers. These niche advocacy groups, the attorneys general argue, should not be given significant weight in the decision-making process.

The battle over washing machine regulations is not just about the appliances themselves; it is a broader fight against the Biden administration’s relentless push for radical energy policies that directly impact the lives of ordinary Americans.
