Federal Gender Identity Rule Blocked In Florida By Judge

A federal judge in Florida has blocked a new Biden administration rule that would expand protections for transgender people under Title IX, a federal law prohibiting discrimination in education programs receiving federal funding.

The rule, issued by the Department of Health and Human Services (HHS) in May 2024, would have defined sex to include gender identity, meaning schools receiving federal funds would be prohibited from discriminating against students based on their gender identity.

Judge William F. Jung of the Middle District of Florida issued a preliminary injunction on Wednesday, July 3rd, halting the rule’s enforcement within the state. This follows similar rulings from judges in Kentucky and Louisiana in recent weeks.

The lawsuit against the rule was filed by Florida alongside several other states. These states argue that the HHS rule oversteps the agency’s authority and infringes upon the rights of parents and students.

“This rule is a blatant attempt to redefine sex under federal law,” said Florida Attorney General Ashley Moody in a statement. “We will continue to fight this unlawful rule that threatens the privacy and safety of our students.”

The Department of Justice (DOJ) has vowed to appeal the ruling.

The ruling is a blow to the Biden administration’s efforts to expand LGBTQ+ rights. It also adds to the ongoing legal battle over transgender rights in the United States.
