RIVERVIEW, Fla. – A homeowner’s conflicts with her HOA over an empty trash bin left at the edge of the road has led to a hefty lawsuit.
The homeowner is in her 70s and has been charged $100 in fines per incident of a trash bin visible on non-collection days.
Cheryl Bishop-Boyd, a resident of Magnolia Park at Riverview since May 2019, has been sued for 13 trash bin violations between 2021 and 2022.

The lawsuit filed by the homeowners association on February 13 indicates she must also pay all attorney fees and any other legal costs. Bishop-Boyd’s current bill is $1,581, according to the HOA’s debt-collecting attorney, Arias Bosinger located in Winter Park, Florida.
An HOA covenant committee meeting in April 2022 was attached as an exhibit to the lawsuit. It states that the “resident was present and shared having knee surgery and currently recuperating…” It also indicates Bush-Boyd was waiting for approval to have bushes planted around the trash bin.
The Free Press inquired to the HOA’s attorneys, asking for a perspective on the case because of the elderly defendant’s walking-related medical issues. There was no response.
Three calls were made to reach Magnolia Park’s community HOA manager to ask if a nominal fee-for-service had been considered to retrieve trash bins for the elderly, but there was no answer.
Bishop-Boyd could not be reached for comment.
