Democrats’ Top Election Lawyer Litigating Nearly 50 Cases Against GOP

The Democratic Party’s top elections attorney and his firm are litigating nearly 50 different post-election cases in 19 states to affect their results, he announced on Sunday night.

The Democratic Party’s top elections attorney and his firm are litigating nearly 50 different post-election cases in 19 states to affect their results, he announced on Sunday night.

Marc Elias, the founder of Elias Law Group, which bills itself as “committed to helping Democrats win, citizens vote, and progressives make change,” announced that it was representing clients in 19 states for a total of 48 cases.

The cases have involved either legal defenses to challenges brought by GOP candidates regarding election issues or efforts to change election laws in favor of Democratic candidates.

The firm’s current case docket includes a challenge to Kansas’ congressional map, with the firm petitioning the U.S. Supreme Court for certiorari, or to hear the case, after losing on appeal. It has also begun representing Democratic candidates elected to office in November’s midterms, such as Gov.-elect Katie Hobbs of Arizona against defeated Republican candidate Kari Lake, as well as Rep.-elect Andrea Salinas of Oregon.

It also represents Democratic Rep. Matt Cartwright of Pennsylvania, intervening in a case filed by his Republican challenger Jim Bognet against the Luzerne County Board of Elections in Pennsylvania’s 8th Congressional District. Bognet has sued to compel the board to undertake a “reconciliation process” before certifying the vote results following paper shortages in Luzerne County on Election Day.

The Law Group has been at the forefront of legal cases involving Democrats in the 2022 midterm elections cycle. Most recently, it represented the Democratic Party of Georgia and Democratic Sen. Raphael Warnock of Georgia, who is running for reelection in the state’s runoff race, in a successful lawsuit seeking to change Georgia’s election law to allow for voting on the Saturday after Thanksgiving.

Elias’ firm also represented Democratic candidates challenging the decision of Cochise County’s Board of Supervisors not to certify the results of their election by Nov. 28, per Arizona state law.

The Board had sought to delay certification to allow for time to conduct due diligence hearings regarding the approval of voting machines for use in the election but was ordered by a judge to certify the results, which it did on Dec. 1, 2022.

The firm, further successfully intervened in a challenge filed by the RNC to Nevada’s Clark County Board of Elections, which had sought to add more Republican election workers to a team verifying the signatures of absentee and mail-in ballot voters. Democratic incumbents eventually won Nevada’s Attorney General, Secretary of State, and U.S. Senate races against Republican challengers.

Elias, who has served as leading counsel to three Democratic presidential campaigns – John Kerry in 2004, Hillary Clinton in 2016, and Joe Biden in 2020 – founded his eponymously named law firm and the nonprofit organization Democracy Docket, which publishes legal information about election-related cases across the country. He previously worked for the progressive law firm Perkins Coie and has been described as “the most prominent Democratic attorney in America” by The Hill.

In the 2020 presidential election, Elias was personally responsible for representing the Biden campaign in 65 election-related lawsuits filed by then-President Donald Trump. He won 64 of them.
