Court To Hear Florida Immigration Fight Against Biden Admin In January

A panel of the 11th U.S. Circuit Court of Appeals will hear arguments in January in a challenge by Florida Attorney General Ashley Moody to federal immigration policies.

The Atlanta-based appeals court said in a filing last week that arguments will be held the week of Jan. 22, though it did not give a specific date.

The Biden administration appealed this spring after rulings by U.S. District Judge T. Kent Wetherell said the immigration policies violated federal law.

The policies, known as “Parole Plus Alternatives to Detention” and “Parole with Conditions,” allowed releasing migrants into the United States amid issues such as overcrowding at detention facilities.

The state has contended, in part, that undocumented immigrants move to Florida, creating costs for such things as the education, health-care and prison systems.

But Biden administration attorneys have argued the state does not have legal standing to challenge the policies.
