SUMTER COUNTY, Fla. – A Florida appeals court has revived a lawsuit against a Sumter County assisted-living facility following the death of a resident in 2019. The lawsuit, filed by the estate of Maria Mosher, alleges negligence and wrongful death after an altercation with another resident led to Mosher’s fatal fall.
Mosher, a resident of the memory-care unit at Sumter Place in The Villages, was involved in an altercation that caused her to fall and hit her head. She tragically passed away four days later.

The lawsuit, initially dismissed by a Sumter County circuit judge, has now been reinstated by the 5th District Court of Appeal. The appeals court ruled that the lawsuit sufficiently presented factual allegations to support claims of negligence and wrongful death.
This decision allows the case to proceed, allowing Mosher’s estate to seek justice and hold the assisted living facility accountable for the circumstances surrounding her death. The case highlights the importance of ensuring the safety and well-being of residents in memory-care facilities and the potential legal consequences when those responsibilities are not met.
