California Law Now Opens Border For Arizona Abortion Doctors

As Arizona grapples with the repeal and recodification of its near-total abortion ban, California has enacted legislation to allow Arizona abortion providers to perform procedures in the Golden State.

California Governor Gavin Newsom signed Senate Bill 233 into law. 

This legislation allows doctors who are in good standing in Arizona to register and perform abortions within the Golden State temporarily.

Arizona’s abortion landscape has been a subject of intense debate and legal wrangling. In May 2023, Governor Katie Hobbs repealed the state’s 1864 law that had effectively banned abortions, with the exception of cases where a mother’s life was at risk. However, this repeal was set to take effect 90 days after the completion of the legislative session, leaving a window of uncertainty.

During this transitional period, the Arizona Supreme Court ruled that the stay on the older abortion law could be lifted, potentially allowing the 1864 ban to be “enforceable” as early as September 26th. This legal ambiguity created a pressing need for alternative options for Arizonans seeking reproductive healthcare.

“Once again, California has made it crystal clear for all who need or deliver essential reproductive care: We’ve got your back,” stated State Senator Nancy Skinner, the author of the bill.

By granting this temporary registration, California has positioned itself as a sanctuary for Arizonan healthcare providers, ensuring that women in need of abortion services can access them without the burden of navigating the legal complexities in their own state.

In Arizona, a proposed constitutional amendment is expected to be on the ballot, allowing citizens to have a more definitive say on the state’s abortion policy.
