Biden Saved Them From Death Row, Now They’re Suing Trump Over Prison Conditions

The Trump administration faces a lawsuit from death row inmates who had received clemency from Joe Biden for forcing them to live in the harshest prison conditions available.

President Donald Trump signed an executive order during his first day as president which instructed Attorney General Pam Bondi to maintain 37 death row inmates in prison conditions that matched their crimes’ severity and danger level as per the lawsuit’s claim of unconstitutionality.

The lawsuit claims that Plaintiffs received indefinite incarceration under harsh conditions because of their clemency from the previous President which demonstrates that both the Attorney General and her deputy exceeded their statutory authority and acted arbitrarily and capriciously without proper legal compliance and procedural notice.

Brandon Basham and Chadrick Fulks stand as some of the defendants in the lawsuit because they were convicted for murdering during a 17-day criminal spree following their jailbreak in 2002.

According to the lawsuit Department of Justice officials directed the Bureau of Prisons to place these inmates in the sole federal supermax prison in Florence, Colorado that forces people to live in near-total isolation.

The Bureau of Prisons (BOP) plans to start transferring inmates from the United States Penitentiary Terre Haute to the USP Florence Administrative Maximum Facility (ADX) no later than April 21.

Thousands of criminals received clemency from Biden during his last days in office. He commuted the sentences of death row inmates as well as those of cop killers and drug traffickers while also granting clemency to individuals convicted in significant public corruption cases.
