Alan Dershowitz Predicts Injunctions Blocking Trump Actions Will Be Overturned On Appeal

Attorney Alan Dershowitz said Monday that many of the federal injunctions currently blocking actions by President Donald Trump—including his executive orders and efforts to curb what he deems wasteful spending—will likely be overturned on appeal and ultimately resolved by the U.S. Supreme Court.

During an episode of his podcast, “The Dershow,” Dershowitz explained that the Trump administration is appealing several injunctions imposed by federal judges. These injunctions target initiatives ranging from the Department of Government Efficiency’s (DOGE) operations to Trump’s January 20 executive order ending birthright citizenship.

“Nobody ever said that our system of checks and balances would make it easy to govern or would make it efficient to govern,” Dershowitz said. “The design of our system was to create enough power to govern effectively while, at the same time, denying any one part of our government enough power to create a tyranny. So we have to counter our system of checks and balances, and it’s working, even today, as we speak.”

Dershowitz elaborated on the process, noting that while state attorneys general have been quick to file lawsuits against the President’s series of executive orders, the judicial roadblocks are temporary. “They search all over the country for the best judges. They hand-pick the judges. They file the lawsuits, and you get judges saying, ‘Uh-uh, no, Mr. President, you can’t do that,’” he said. “But ultimately, those issues are brought up to the court of appeals and eventually to the Supreme Court. It will be resolved.”

The attorney pointed to an instance involving United States District Judge John J. McConnell Jr. of Rhode Island, who had threatened criminal contempt charges over a spending freeze ordered by Trump. “President Trump has never defied a court order, and he has indicated that he would comply with them, but he needs to know that he has the right to appeal these orders. Many of them will be found to be improper. The courts don’t have the power to stop this or stop that,” Dershowitz added.

Dershowitz also criticized Democrats who recently protested outside the headquarters of the United States Agency for International Development and the Treasury Department. The protests came after Tesla CEO Elon Musk, acting as chairman of DOGE, announced plans to close down the agency. “People keep forgetting the bureaucracy isn’t an independent branch—it’s part of the executive, and the executive is the president,” he remarked. He further noted that while many federal agencies were created by Congress, the President retains the authority to remove agency heads at will.

As the administration appeals the injunctions, Dershowitz expressed confidence that the legal challenges will eventually be resolved in favor of the President’s actions. “Ultimately, the issues will be sorted out by the Supreme Court,” he said.

With multiple high-profile legal battles unfolding, the coming months promise to be a critical period for the Trump administration as it navigates the complex interplay between executive action and judicial oversight.
