A Massachusetts judge is facing renewed scrutiny for her alleged role in helping an illegal immigrant evade federal immigration authorities in 2018. Judge Shelley M. Richmond Joseph is accused of “willful judicial misconduct” and actions “unbecoming” of a judicial officer, according to charges filed by the Massachusetts Commission on Judicial Conduct.
The charges stem from an incident where Joseph allegedly allowed Jose Medina-Perez, an illegal immigrant from the Dominican Republic with a history of prior deportations, to escape from her courtroom through a backdoor to avoid an Immigration and Customs Enforcement (ICE) officer waiting outside.

Medina-Perez had been arrested on drug charges and was due in court. An ICE officer was present to take him into custody following the proceedings. However, Joseph allegedly orchestrated Medina-Perez’s release through a rear exit, effectively thwarting the ICE officer’s apprehension.
This incident sparked outrage among immigration enforcement officials and highlighted the ongoing tension between local authorities and federal immigration agencies. Thomas Homan, former acting director of ICE, expressed his astonishment at the time, stating that he had “never seen anything like that” in his 35-year career.

Joseph was initially charged with obstruction of justice in 2019 but maintained her innocence. Federal prosecutors ultimately dropped the charges in 2022 in exchange for her agreement to refer herself to the Commission on Judicial Conduct for investigation.
The commission’s findings, which have been filed with the state Supreme Judicial Court, could result in disciplinary action against Joseph, ranging from a reprimand to removal from office. This case underscores the complex legal landscape surrounding immigration enforcement and the potential consequences for officials who attempt to obstruct federal authorities.
