Former federal prosecutor Andy McCarthy voiced sharp criticism during a Monday segment on FOX News of President Joe Biden’s pardoning of his son, Hunter Biden.
McCarthy described the situation as one mired in “mendacious political calculations,” arguing that the handling of Hunter Biden’s legal issues undermined the administration’s repeated claims that “no one is above the law.”
McCarthy acknowledged the understandable emotional difficulty for a father faced with his son’s legal troubles. “I think anyone, certainly as a father, could understand wanting to spare your child from imprisonment,” he said. “But President Biden could have been honest about it from the beginning.”

Instead, McCarthy accused the Biden administration of prioritizing political optics over transparency. “They wouldn’t pardon him before the election because they knew it would anger voters,” he argued. “So, they lied again and again. The lies were driven by the election calendar.”
McCarthy dismissed claims that Hunter Biden faced harsher treatment because of his family connections, arguing the opposite was true. “Hunter Biden got break after break because he was the president’s son,” He stated. “The idea that he was singled out is absurd. They actually tried to make the case against him disappear, something no ordinary American would experience.”
He also criticized President Biden’s public statements defending his son, calling them misleading. Referencing Biden’s claim that paying back owed taxes should resolve legal issues, McCarthy retorted, “If I rob a bank but return the money, that doesn’t mean I didn’t commit a crime. It’s a silly argument.”

On the gun charges, McCarthy explained that Hunter Biden’s case involved successfully obtaining a firearm after falsely completing a federal background check—a crime he said is routinely prosecuted. “These cases are brought all the time, and they didn’t want to prosecute him initially,” McCarthy said. “He got special treatment.”
While discussing the pardon, FOX News panelists noted that Biden has insisted no one is above the law. McCarthy, however, argued that the administration’s actions don’t align with those claims.
“Had Biden looked America in the eye and said, ‘This is my son, and I’m going to pardon him,’ people might have respected the honesty,” McCarthy said. “Instead, we got a series of lies, timed around political calculations.”
