U.S. Congressman Matt Gaetz (FL-01) Tuesday introduced the “Judicial Action to Impose Liability for Alien Voters Act,” or “JAIL for Alien Voters Act.”
The legislation aims to impose felony charges on non-U.S. citizens who vote illegally, aligning with a recent statement by former President Donald Trump that warned, “If you vote illegally, you’re going to jail.”
If enacted, the act would punish illegal voting by non-citizens with up to five years in prison or a $10,000 fine, mirroring penalties for U.S. citizens convicted of unlawful voting.
Earlier this month, Gaetz also proposed the “National Motor Voter Clarification Act,” a bill designed to enable states to remove non-citizens from their voter rolls at any time, a response to a lawsuit filed by the Biden-Harris Department of Justice against Virginia for removing illegal aliens from its voter rolls.
Together, the two bills aim to strengthen election security against unauthorized voting, particularly given the high number of illegal border crossings under the current administration.

“President Donald Trump is right: illegal aliens who vote in our elections should be in jail. It is unacceptable that illegal aliens get lighter sentences for defrauding our elections than U.S. citizens. My legislation, the JAIL for Alien Voters Act, will create parity in punishment for those who commit voter fraud, regardless of immigration status. It’s common sense that U.S. citizens should be the only ones voting in U.S. elections.” said Gaetz.
Cosponsors of the JAIL for Alien Voters Act include Reps. Andy Ogles (TN-5), Andy Biggs (AZ-5), Mike Collins (GA-10), Claudia Tenney (NY-24), and Barry Moore (AL-02).
