Kentucky Schools Accused Of Election Interference, First Amendment Violations

The Liberty Justice Center is challenging two Kentucky public school districts for allegedly using taxpayer resources to oppose a ballot measure that would expand school choice in the state.

Daviess County and Owensboro Public Schools announced a joint board meeting featuring a presentation by the Kentucky School Boards Association (KSBA), a vocal opponent of Amendment 2.

This amendment, on the November 5th ballot, would allow the state legislature to fund students attending schools outside the public system.

The Liberty Justice Center argues that using school resources, including social media accounts and staff time, to advocate against Amendment 2 violates Kentucky law prohibiting the use of public funds for political activity. They have filed a complaint with the Kentucky Attorney General’s office.

Furthermore, the schools are accused of violating constituents’ First Amendment rights by blocking social media comments on posts about the meeting and prohibiting attendees from bringing signs or wearing clothing expressing opinions on the amendment.

The Liberty Justice Center warns that they are prepared to take legal action if individuals are denied entry or forced to remove items expressing their views on Amendment 2 at the meeting.
