Florida Rep. Matt Gaetz Demands DOJ Clarify Authority Behind Jack Smith’s Actions In Trump Case

Congressman Matt Gaetz (R-FL) has sent a letter to U.S. Attorney General Merrick Garland, seeking clarification on who authorized Special Counsel Jack Smith to continue his investigation into former President Donald Trump.

Gaetz is questioning Smith’s authority following a federal judge’s ruling that his appointment was unlawful.

Gaetz is specifically demanding information regarding Smith’s recent superseding indictment against Trump and his argument before the 11th Circuit Court of Appeals.

He points out that, according to the Justice Manual, any action that may impact an election requires consultation with the Public Integrity Section, and Gaetz is asking for evidence that this protocol was followed.

In the letter, Gaetz requests:

  1. Documentation of any authorization issued between July 15, 2024, and now, enabling Smith to continue his work.
  2. Any DOJ directives, legal opinions, or regulations supporting Smith’s ongoing involvement.
  3. Answers regarding consultations with the Public Integrity Section and other DOJ officials before filing the superseding indictment.

Gaetz has given the DOJ a deadline of September 27, 2024, to provide this information, emphasizing the need for transparency in the actions taken by the Special Counsel’s office.
