If convicted, they face a mandatory minimum sentence of 20 years in prison, with a maximum penalty of life imprisonment and a fine of up to $1,000,000.

Prior to the federal indictment, Nelson was also facing state charges in Yankton County related to the distribution of a controlled substance to a minor, resulting in death. These state charges will now be dismissed.

Both U.S. Attorney Alison Ramsdell and South Dakota Attorney General Marty Jackley emphasized the importance of strong collaboration between federal and state law enforcement in combating the fentanyl crisis.
