Maryland ICE Agents Arrest Illegal Immigrant Convicted Of Rape

Enforcement and Removal Operations (ERO) Baltimore apprehended 19-year-old Henry Argueta-Tobar, a Guatemalan national unlawfully present in the U.S., who was convicted of raping a Maryland resident. Argueta-Tobar was arrested by ERO Baltimore’s Fugitive Operations Team on August 14 in Waldorf.

“Henry Argueta-Tobar unlawfully entered the U.S., came to Maryland, and harmed a resident,” said Vernon Liggins, Acting Deputy Field Office Director of ERO Baltimore. “We will not allow individuals like him to continue threatening our communities. ERO Baltimore remains dedicated to ensuring public safety by targeting unlawfully present sexual predators and serious criminal noncitizens.”

Argueta was first apprehended by U.S. Border Patrol on May 21, 2019, after unlawfully entering the U.S. near El Paso, Texas, as a minor. After being served with a notice to appear before a Department of Justice immigration judge, Argueta was transferred to ERO El Paso on May 23, 2019, and released on an order of recognizance.

On December 22, 2023, the Charles County Sheriff’s Office arrested Argueta and charged him with second-degree rape. ERO Baltimore issued an immigration detainer against Argueta on December 27, 2023, while he was held at the Charles County Detention Center in La Plata. However, the detention center did not honor the detainer and released Argueta on an unknown date.

On February 12, a Department of Justice immigration judge in Baltimore ordered Argueta’s removal to Guatemala. Meanwhile, on July 3, the Circuit Court for Charles County convicted him of second-degree rape and sentenced him to 20 years in prison, followed by five years of supervised probation, though all but 190 days of his prison sentence were suspended.

ERO Baltimore’s Fugitive Operations Team subsequently arrested Argueta in Waldorf, where he remains in ERO custody.
