Arkansas Lawyer Sues Florida-Based Morgan & Morgan Over Alleged Misleading Advertisements

An Arkansas attorney, Jody Shackelford, has filed a lawsuit against the national plaintiffs firm Morgan & Morgan Complex Litigation Services, P.A., alleging that the firm’s advertisements in the state unfairly contain testimonials and dramatizations.

Filed on July 17 in the United States District Court for the Eastern District of Arkansas, the complaint claims that Morgan & Morgan’s advertising practices violate both federal and state laws.

According to the lawsuit, the firm’s use of client testimonials and dramatizations breaches Arkansas Rule of Professional Conduct 7.2, which aims to prevent misleading and deceptive practices by prohibiting such content in legal advertisements.

Shackelford contends that these advertisements mislead consumers by implying compliance with local professional conduct rules, consequently harming his business by diverting potential clients.

The lawsuit also cites violations of Section 5(a) of the Federal Trade Commission Act and Federal Communications Commission regulations against false or misleading advertising. Shackelford seeks compensatory and punitive damages, as well as a preliminary and permanent injunction to stop Morgan & Morgan from continuing these advertising practices.
