U.S. Senator Marsha Blackburn (R-Tenn.), joined by Senator Bill Hagerty (R-Tenn.) and other colleagues, has called on U.S. Attorney General Merrick Garland to provide clarity on the Department of Justice’s (DOJ) actions to prevent non-citizens from registering to vote in American elections.
This inquiry follows proactive measures by state officials in Tennessee, South Carolina, Georgia, and Ohio to address and investigate instances of illegal voter registration by non-citizens.
In a letter to Attorney General Garland, the Members of Congress highlighted the significant rise in border encounters since President Biden took office.

Nearly 10 million individuals have either been released into or evaded apprehension while entering the U.S.
“As you are likely aware, the United States has experienced a record number of border encounters since President Biden took office—nearly 10 million—many of whom have been released into, or evaded apprehension while entering, the U.S.,” the Members of Congress wrote. “We’re writing to inquire regarding the efforts undertaken by your Department to enforce the law that prohibits non-citizens from voting in our elections.”

“Plainly, there are opportunities for and instances of non-citizen voter registration, and so the critical question is whether the laws against doing so are being enforced by your Department,” the Members of Congress continued. “There appear to have been few prosecutions by your Department under these laws, and there is no indication that you have been pursuing cases in places like Georgia and Ohio where aliens have been caught registering or voting.”
According to the Federation For American Immigration Reform (FAIR), mass illegal immigration has significantly impacted American electoral politics.
Although noncitizens are illegal to vote in federal elections, they are still counted when apportioning congressional districts.
Areas with large populations of noncitizens gain additional representatives in Congress. Consequently, these states also receive more electors in the Electoral College, indirectly influencing presidential elections.

FAIR says that there is evidence that both legally present foreign nationals and illegal aliens, who have already broken the law by their unauthorized presence in the country, have voted in recent elections. During the 2016 election cycle, noncitizens were found on voter registration rolls in Virginia and Pennsylvania.
Additionally, the Office of the U.S. Attorney for the Western District of New York charged a Canadian woman with making a false claim to citizenship after she registered and voted in more than 20 elections.
