In a unanimous decision, the Supreme Court has rejected a challenge to the Food and Drug Administration’s (FDA) approval of mifepristone, a widely used abortion pill.
The court ruled that the plaintiffs, a group of doctors opposed to abortion, lacked the legal standing to bring the lawsuit as they were not directly harmed by the medication.pen_spark
The case, considered the most significant abortion-related case since the overturning of Roe v. Wade in 2022, centered around the doctors’ claims that the FDA’s approval of mifepristone in 2000 and subsequent changes to its regulations were unlawful. They argued that the drug posed risks to women’s health and safety.

However, the Supreme Court disagreed, stating that the doctors’ desire to make the drug less available for others did not establish standing to sue. This ruling preserves access to mifepristone, which is used in over half of all abortions in the U.S., and is considered safe and effective by leading medical organizations.
The decision has been met with relief by abortion rights advocates, who feared that a ruling against the FDA could have severely restricted access to medication abortion. Meanwhile, anti-abortion groups have expressed disappointment but vow to continue their fight against abortion access through other legal avenues.
The Supreme Court’s ruling avoids a direct confrontation on the merits of the case, leaving the FDA’s regulations for mifepristone intact. The decision is seen as a significant victory for the Biden administration, which defended the FDA’s authority to regulate medications and argued that the plaintiffs lacked standing to challenge the agency’s decisions.
While the ruling preserves access to mifepristone for now, the future of abortion rights remains uncertain in the wake of the Dobbs v. Jackson Women’s Health Organization decision, which overturned Roe v. Wade and allowed states to impose stricter abortion restrictions. The battle over abortion access is expected to continue in state legislatures and courts across the country.
