47-Year-Old Florida Man Arrested On Jan 6 Capitol Riot Charges

A Florida man has been arrested on felony and misdemeanor charges related to the breach of the U.S. Capitol on Jan. 6, 2021.

Marcus Smith, 47, of Fleming Island, Florida, is charged in an indictment filed in the District of Columbia with a felony offense of destruction of property and aiding and abetting.

In addition to the felony, Smith is charged with several misdemeanor offenses, including:

  • entering and remaining in a restricted building or grounds
  • disorderly and disruptive conduct in a restricted building or grounds
  • engaging in physical violence in a restricted building or grounds
  • disorderly conduct in a Capitol building
  • act of physical violence on Capitol grounds or buildings
  • parading, demonstrating, or picketing inside a Capitol building.

Smith was arrested on Friday, Jan. 26, 2024, by the FBI in Florida and made his initial appearance in the Middle District of Florida.

The U.S. Attorney’s Office is prosecuting this case for the District of Columbia and the Department of Justice National Security Division’s Counterterrorism Section.

This case is being investigated by the FBI’s Jacksonville and Washington Field Offices. The U.S. Capitol Police and the Metropolitan Police Department provided valuable assistance.

In the 36 months since Jan. 6, 2021, more than 1,265 individuals have been charged in nearly all 50 states for crimes related to the breach of the U.S. Capitol, including more than 440 individuals charged with assaulting or impeding law enforcement, a felony. The investigation remains ongoing.
