A second arrest has been made in connection with a New Year’s Day shooting incident at a Waffle House in Florida that left a man seriously injured.

A second arrest has been made in connection with a New Year’s Day shooting incident at a Waffle House in Florida that left a man seriously injured.

According to deputies, Dion Barnes, 32, was located in Lehigh Acres, where members of the Collier County Sheriff’s Office Fugitive Warrants Bureau assisted Lee County deputies with taking him into custody on CCSO warrants.

Barnes is currently in the Lee County jail awaiting his return to Collier County, where he faces felony charges of aggravated battery and possession of a firearm by a convicted felon.

“Thanks to the persistence and diligence of our hardworking detectives, the final arrest has been made and this investigation is now closed,” Collier County Sheriff Kevin Rambosk said.

Detectives said this was an isolated incident that stemmed from an altercation several years ago between Barnes and the gunshot victim.

The investigation revealed Barnes shot the victim in the stomach after Barnes was attacked by the victim and two other men inside the Waffle House at 3824 Tollhouse Drive about 5 a.m. on Jan. 1.

The victim’s injuries were non-life threatening.

On Jan. 11, detectives arrested Derrick Earl Peart, 22, of Estero, and charged him with tampering with evidence after the investigation found he got rid of the gun that was used in the shooting. The gun was never recovered.

After Peart got rid of the gun, detectives said he drove the gunshot victim to the hospital. On the way to the hospital, Peart crashed the vehicle into a guardrail.

Peart also faces fraud charges after deputies got a search warrant for the vehicle and found various items of personal identification such as medical insurance cards and debit card paperwork belonging to other individuals.
